These Terms & Conditions ("Terms") govern your access to and use of the EduPlayKids website and online service available at www.eduplaykids.com (the "Service"), operated by Zayeen, LLC ("Service Provider", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. We recommend reading these Terms carefully before using the Service.

1. About EduPlayKids

EduPlayKids is an educational service that helps young children (approximately ages 1–6) learn letters, numbers, colors, animals, shapes, and more through voice-guided, interactive games. The Service is accessed through a web browser and requires an active internet connection. Some content is available for free, while certain premium content requires a paid subscription (see Section 5).

2. Eligibility & Children's Use

The Service is designed to be used by children under the supervision of a parent or legal guardian. Accounts may only be created and managed by an adult (18 years or older) who is the parent or legal guardian of the child using the Service. By creating an account or allowing a child to use the Service, you confirm that you are that responsible adult and that you consent to the child's use of the Service and to these Terms on their behalf. You are responsible for supervising your child's use of the Service.

3. Accounts & Security

To access certain features you may need to create an account. You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Please notify us promptly of any unauthorized use. We are not liable for any loss arising from your failure to keep your account secure.

4. Intellectual Property

All content and materials on the Service — including games, text, images, audio, software, and the EduPlayKids name and logo — are owned by or licensed to the Service Provider and are protected by intellectual property laws. You may use the Service only for personal, non-commercial, educational purposes. Unauthorized copying, modification, distribution, public display, reverse engineering, or creating derivative works from any part of the Service is strictly prohibited. All trademarks, copyrights, database rights, and other intellectual property rights related to the Service remain the property of the Service Provider.

5. Free and Premium Subscriptions

Core features of EduPlayKids are free to use. We also offer optional Premium subscriptions that unlock additional premium content, billed on a monthly or yearly basis. By purchasing a subscription you agree to the following:

Prices and the features included in each plan are shown at the point of purchase and may change from time to time. Any change will be communicated clearly before it takes effect.
Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless cancelled beforehand.
You may cancel at any time through your account settings or the platform you used to subscribe. Cancellation stops future renewals; you keep premium access until the end of the current paid period.
Except where required by applicable law, payments are non-refundable. If your purchase was made through a third-party platform (for example, an app store or payment provider), that platform's billing, cancellation, and refund policies also apply.
After a subscription ends, your child can continue to use the free content.

6. Acceptable Use

You agree not to misuse the Service. In particular, you must not: use the Service for any unlawful purpose; attempt to gain unauthorized access to our systems or other users' accounts; interfere with or disrupt the Service; or attempt to extract source code, or copy, translate, or create derivative versions of the Service.

7. Availability, Changes & Termination

We are committed to keeping the Service useful and reliable, and we may update, improve, or modify it at any time. We do not guarantee that the Service will always be available, uninterrupted, or error-free, and some features depend on your internet connection. We may suspend or discontinue the Service, or terminate your access, at any time. Upon termination, the rights granted to you under these Terms will end and you must stop using the Service.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. While we strive to keep content accurate and up to date, we do not warrant that it is complete, reliable, or suitable for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, or consequential loss or damage arising from your use of, or inability to use, the Service.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, United States.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by posting the updated Terms on this page and revising the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
